Zetomed-Doctor Registration Terms & Condition

1. Definitions
1.1. “Doctor” means a medical practitioner registering with Zetomed to provide consultation services via the Platform.
1.2. “Platform” means the Zetomed website, mobile app and associated services.
1.3. “Services” means any consultation (video, audio, chat), digital prescription issuance, follow-up services, telemedicine interactions and any other doctor-facing feature offered by Zetomed.
1.4. “Patient” means a user of the Platform who books or receives a consultation via the Doctor.
1.5. “Telemedicine Guidelines” means the regulations issued by National Medical Commission (or its predecessor body) and any related Indian laws governing telemedicine, e-prescriptions, and medical practice in India.
1.6. “Registration” means the process by which a Doctor signs up, submits required credentials and is accepted to offer consultations on the Platform.
2. Eligibility & Registration
2.1. Doctor must:
be duly qualified and registered with the appropriate medical regulatory authority in India (or the relevant state) and hold a valid registration number;
submit accurate credentials, license number, qualifications, speciality, experience and any other required documentation to Zetomed;
consent to the verification of such credentials by Zetomed or its agents.
2.2. By registering, the Doctor represents and warrants that they are legally permitted to practice medicine and provide teleconsultation services under applicable Indian laws and Telemedicine Guidelines.
2.3. Zetomed reserves the right to accept or reject a Doctor’s registration at its sole discretion, without giving any reason.
3. Services Provision & Platform Use
3.1. The Doctor agrees to provide consultation services through the Platform in accordance with the Telemedicine Guidelines and any other standard of care applicable to their speciality.
3.2. The Doctor shall:
ensure that the Patient is properly identified (name, age, gender, contact) and give consent to teleconsultation where required;
conduct the consultation in a professional, ethical, and confidential manner;
issue a digital prescription following the applicable format, law and Platform procedures;
update any post-consultation notes, follow-up advice or referrals as required.
3.3. The Doctor acknowledges that the Platform may make available the tools (video, audio, chat, prescription generation, follow-up) and the Doctor agrees to use them responsibly and in accordance with Zetomed’s policies.
4. Compliance, Professional Conduct & Liability
4.1. The Doctor shall comply with all applicable laws, regulations and guidelines, including but not limited to: the Medical Council / State Medical Council rules, the Telemedicine Guidelines, the national pharmacy laws, and data protection/privacy laws.
4.2. The Doctor shall maintain professional indemnity insurance (if required in their practice) and shall notify Zetomed immediately of any disciplinary action, complaint, or regulatory issue arising.
4.3. The Doctor agrees to adhere to Zetomed’s policies on patient data, confidentiality and platform security and shall not misuse the Platform or patient-data access.
4.4. The Doctor acknowledges that Zetomed is a platform and does not substitute the Doctor’s professional judgement. The Doctor remains solely responsible for clinical decisions, diagnoses, treatment, prescriptions and follow-ups.
4.5. The Doctor shall indemnify, defend and hold harmless Zetomed and its affiliates from any claim, liability, cost or loss arising from the Doctor’s negligence, misconduct, breach of terms, professional acts or omissions.
5. Prescriptions, Medicine Delivery & Follow-up
5.1. The Doctor shall issue digital prescriptions in compliance with applicable legal and regulatory standards; misuse (such as prescribing controlled substances without proper indication) is prohibited.
5.2. Where medicine delivery is involved via the Platform, the Doctor shall ensure that prescription details are clear, accurate and consistent with the Patient’s consultation.
5.3. The Doctor may offer follow-up consultations (free or paid) as per the Platform’s terms; any such follow-up must still comply with the same standards as initial consultations.
6. Platform Fees, Payment & Remuneration
6.1. Details of remuneration, fees, billing or revenue-share (if applicable) will be separately agreed between the Doctor and Zetomed via a schedule or onboarding agreement.
6.2. The Doctor authorises Zetomed to deduct any applicable platform service fees, taxes or other charges from payments due to the Doctor as per the agreed schedule.
7. Intellectual Property & Data
7.1. The Doctor grants Zetomed a non-exclusive, worldwide, royalty-free licence to host, store, display and transmit any consultation content (excluding proprietary clinical knowledge) insofar as required for Platform operations, patient records, audit or regulatory requirement.
7.2. The Doctor acknowledges that all trademarks, logos, Platform branding remain the property of Zetomed, and the Doctor shall not use them outside the Platform without prior written consent.
7.3. The Doctor shall comply with Zetomed’s data-protection policies; patient data collected via the Platform shall be handled in accordance with Zetomed’s Privacy Policy and applicable law.
8. Term & Termination
8.1. This agreement begins when the Doctor’s registration is accepted by Zetomed and continues until terminated by either party.
8.2. Either party may terminate this relationship for convenience by giving [___X days]’ written notice (or via email) or immediate termination for cause (e.g., breach of terms, regulatory action, misconduct).
8.3. Upon termination, the Doctor shall cease using the Platform, remove any links/branding, and fulfil any pending consultations. Zetomed may disable access to the Doctor’s profile and withhold pending payments as per the agreed schedule.
9. Confidentiality
9.1. Both Zetomed and the Doctor shall keep confidential all non-public information shared under this agreement including patient data, business information and proprietary Platform details.
9.2. Obligations of confidentiality survive termination of registration.
10. Limitation of Liability & Disclaimers
10.1. Zetomed (and its officers, employees, agents) shall not be liable for any indirect, incidental, special or consequential damages arising from the Doctor’s registration, use of the Platform or provision of Services.
10.2. Zetomed’s maximum aggregate liability to the Doctor under this agreement shall not exceed the total amount paid or payable to the Doctor by Zetomed in the preceding [12 months] (or another cap as may be agreed).
10.3. Zetomed makes no warranties (express or implied) regarding uptime, availability of Patients, business volume, or any particular result from use of the Platform.
11. Amendments
11.1. Zetomed reserves the right to amend these Terms at any time. Zetomed will publish the revised Terms on the Platform and notify registered Doctors by email. Continued use of the Platform after publication constitutes acceptance of the revised Terms.
12. Governing Law & Dispute Resolution
12.1. These Terms shall be governed by and construed in accordance with the laws of India.
12.2. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Lucknow, Uttar Pradesh (or another mutually agreed jurisdiction).
13. General Provisions
13.1. The headings in this document are for convenience only and do not affect interpretation.
13.2. If any provision is held invalid or unenforceable, the remaining provisions shall remain in full force and effect.
13.3. This agreement constitutes the entire understanding between Zetomed and the Doctor regarding the subject-matter and supersedes all prior discussions, agreements or understandings (written or oral).
